Postponenment Of The Regulation Reg. The One-Car Parking Lot Condition For Each Flat

With the “Regulation on the Amendment of the Parking Lot Regulation” published in the Official Gazette dated 19.12.2020 and numbered 31339, the provisional article 4 of the Parking Regulation published in the Official Gazette dated 22.02.2018 and numbered 30340 has been amended. The change is as follows:

 

“Building permit applications made before or after the effective date of this Regulation; If requested, it will be finalized according to the previous Regulation before the entry into force of this Regulation, until 31/3/2021.”

 

Therefore, the effective date of the regulation has been postponed to 31.03.2021.

Changes Brought by the Parking Lot Regulation:

 

Within the scope of the Parking Lot Regulation dated 22.02.2018, there are many new regulations such as making parking in accordance with the parking lot needs of the buildings, the construction conditions of the parking lots, and the dimensions of the parking lots.

 

With the regulation, it has become compulsory to meet the parking lot need of the buildings in the parcel or inside the building, and the car parks built are accepted as common areas according to the Property Ownership Law. Also, it has become compulsory to have bicycle and motorcycle parking spaces in the parking lots to be built in the buildings.

 

While a parking lot was determined for every 3 flats before the regulation, it became mandatory to determine a parking lot for each flat with the Regulation. Parking lots must be shown in construction projects and must be specified in the deed. If the parking requirement cannot be met; If possible, it will be met in the form of common parking with neighboring parcels or in-island parking applications, or it will be covered from parking areas other than that must be reserved in other parcels or buildings that are not subject to expropriation within the walking distance determined by the administration, provided that an indefinite easement is established and specified in the declarations section of the land registry.

 

In addition; Public use places such as cinemas, theaters and hotels will also need to have a car park.

 

With the amendment in the relevant regulation, the requirement of one-car parking lot for each flat was postponed to 31 March 2021.
