The new Coronavirus (COVID-19) first appeared in the Wuhan Province of China in late December of 2019, first influencing the People's Republic of China and then other countries of the world. The coronavirus was accepted by the World Health Organization (WHO) as a pandemic on March 11, 2020 and the severity of the condition was registered.

In Turkey, the March 10, 2020 as the date of the determination of the first case since the outbreak of coronavirus taken a series of measures to prevent the spread rate. One of these measures is the postponement of sports competitions.

With the announcement of the Minister of Youth and Sports, handball, volleyball, basketball and football leagues were postponed until a certain date on March 19, 2020. In this regard, the postponement of leagues and matches are of particular interest to those who are members of the Sports Package belonging to broadcasters.

Since the league and matches have not been held since March 19, 2020, TV Sports package subscribers cannot use their existing subscriptions. In this article, we briefly talked about what TV subscription owners can not legally benefit from the service they have purchased.

During the period we are in, service providers offer alternative solutions to their users in different ways and we recommend that the parties reach an agreement by negotiating the negotiations they will carry out or by signing new contracts.

If this is not possible, there will be an opportunity to apply to the “Excessive Difficulty” institution regulated by the Turkish Code of Obligations. The coronavirus outbreak revealed an extraordinary situation that was not expected to be known by the parties at the time of the contract. In accordance with the above-mentioned arrangement, the owners of TV subscriptions can request that the contract price be adapted to the new conditions by applying to the Consumer Arbitration Committees either by court, or by using the right to terminate the contract, they can take back the fees they have paid during the pandemic period.

We would like to remind you that in order to benefit from excessive performance difficulties, TV subscription owners have not yet paid the fee for the service or have paid the rights reserved above.

In summary, owners of TV subscriptions are unable to use the additional sports packages they purchased during Pandemic. Although service providers are able to extend / suspend subscription packages to their users, etc. Although it provides different applications and facilities, users will be able to exercise their rights within the scope of this article through court or Consumer Arbitration Committees.
