Communiqué On Implementation Of Surveillance In Imports

SURVEILLANCE APPLICATION

The goods specified in the attached table will only be imported with a surveillance certificate to be issued by the Ministry of Trade (General Directorate of Imports). The surveillance document will be sought by the relevant customs administration at the registration of the customs declaration.

APPLICATION

Applications for these surveillance document requests are submitted under the “E-Services” and “E-Transactions” under “Import Document Transactions” on the website of the Ministry of Commerce (Ministry) within the scope of the Customs Single Window System (System). It will be done with an electronic signature in the “Introduction to E-Signature Applications” section in the section. It is also possible to apply via e-Devlet (www.turkiye.gov.tr).

Authorization of electronic signature holders to make applications on behalf of companies within the scope of this Communiqué will be made within the framework of the Communiqué on Authorization for Electronic Application for Import Transactions (Import: 2023/21) published in the Official Gazette dated 31/12/2022 and third repeated numbered 32060.

In the applications made within the scope of this Communiqué, on the “New Application Entry” screen under the “Application Transactions” main title on the “Import Document Transactions” page specified in the first paragraph, “TPS-0964-Surveillance Document Industry” in the document type field, and this Communiqué in the “Communiqué/Decision” field. will be selected.After completing the application form electronically and uploading the forms and documents in Annex-2 to the system, the application will be completed by signing with an electronic signature by the authorized user.

If the application cannot be made due to the difficulties that may be experienced in the electronic environment, the applications can also be made physically. In this case, the application form in Annex-1 of the communiqué will be used and the trade registry certificate of the applicant will be attached to the application form.

EXAMINATION

The originals of the documents related to the applications made within the scope of the communiqué on the implementation of surveillance in imports may be requested from the applicant by the Ministry. In addition, additional information and documents may be requested in case of deficiencies or inconsistencies in the submitted information and documents.

ISSUANCE OF SURVEILLANCE DOCUMENT AND NOTIFICATION TO THE APPLICANT

The surveillance document will be issued electronically and a notification will be made to the e-mail address in the application form. The notification will include the 23-digit document number given by the system and the date of the document, and this information will be declared by the obligor in the “Document Reference No” and “Document Date” fields in box 44 of the declaration.

No written notice will be given to the applicant.In case the system registration of the surveillance document cannot be approved due to the applicant’s lack of registration at the customs administration, the General Directorate of Imports will notify the e-mail address in the application form. Upon the notification, the importer will register to the system within five working days and the General Directorate of Import will be informed. Otherwise, the application will be deemed invalid.

SANCTION

If it is determined that the information and documents submitted during the application or examination phase are untrue or that there are inconsistencies or deficiencies in the information and documents submitted, the surveillance document will not be issued until the said inconsistency or deficiency is corrected.

INFORMATION ON THE SURVEILLANCE DOCUMENT AND ITS USE

The validity period of surveillance documents is six months.The surveillance document shall not prevent the implementation of the provisions of the Customs Law No. 4458 dated 27/10/1999 regarding the customs value of the goods.

NOTICE OF REPEAL 

With this communiqué, the Communiqué on the Implementation of Surveillance in Imports (Communiqué No: 2013/6) published in the Official Gazette dated 20/4/2013 and numbered 28624 was repealed.
