Biographical works are works about a person’s lifetime and these works generally contain personal data. In this context, as long as the correct information in the biographical work to be prepared is not confidential, it can be published. The publication and use of biographical works are subject to various legal regulations, including issues such as the protection of personal data, copyright and freedom of expression.
In biographical works, while providing information about a person’s life and experiences, it is important to present this information in an accurate, reliable and balanced manner. First of all, it should be noted that disclosure of publicly available information cannot be considered as a violation of the right to privacy. However, in such works, the violation of personal rights may arise in different ways. For example; If the biography claims to convey accurate information about the life of a public figure, the criteria used in cases related to freedom of the press may also be applied in such disputes, and the person about whom the work is made may apply to the judiciary to prevent the publication of inaccurate information or intimate details of his/her private life. It should also be noted that the fact that permission is not obtained from the person on whom the work is made does not directly cause a violation of personal rights, and the fact that permission is obtained does not mean that there will be no violation of personal rights in any way. For example; the resulting work may include some untrue matters or intimate information about private life by going beyond the scope of the consent given by the person studied. Even if the untrue information about the person who is the subject of such a work seems insignificant when the events are viewed objectively, the publication of the work subject to such a transfer can be stopped.
