In Article 1 of the Regulation, Permanent Data Storage is defined as “Short message, e-mail, internet, disc, CD, DVD, memory card and any similar tool or media which ensures that the information sent to the consumer is recorded in a way that allows the examination of this information for a reasonable period of time in accordance with its purpose and is copied without changing it and that this information can be accessed exactly.
According to Article 2 of the Regulation, it is possible to give the Certificate of Guarantee through the Permanent Data Storage or in writing on paper. If the consumer requests it, it is obligatory to give the Warranty certificate in writing on paper.
The obligation to include the title, address, telephone and other contact information of the seller, as well as the signature and stamp of the authorized person, the date and number of invoices, the date of delivery of the goods to the consumer, and data information in the warranty certificate has been abolished in distance contracts pursuant to third article of the regulation. It is regulated that the information in the invoice in the warranty certificate will be taken as basis in the contracts established at a distance. However, if the warranty certificate is given with a permanent data storage personnel, the condition of signature and stamp is not required.
With the Article 5 of the Regulation, new products have been added to the List of Products that are Mandatory to be Sold with a Warranty Certificate in accordance with the Law on the Protection of the Consumer. These products are:
- Baby Monitoring Cameras and Parent Monitors
- Book Readers for the Visually Impaired
- USB Fans
- Hydromassage Systems and Jacuzzis, Shower Cabins, Electric Saunas
- Angle Grinders
- Tablets, Virtual Reality Glasses, Memory, Graphics Cards, Laptop Coolers, Smart Pens
- In-Vehicle Cameras, Smart Home and Automation Systems, Audio and Video Conversation Systems
- Smart TV Boxes, Positioning Devices with Satellite Assistance
- ATV Vehicles, Motor Bicycles, Motor Scooters, Yachts, Electric Skateboards, Battery Vehicles for Children
- Smart Watches and Wristbands, Diving Watches and Computers
- Baking Sheets, Paper Grinding and Shredders
- Face Mask Machines, Skin Cleaning Devices
- Waffle Machines
- Violin
- Glass Balconies, Electric Shutters
WHAT ARE THE INNOVATIONS AND CHANGES BROUGHT WITH THE REGULATION ON AMENDING THE AFTER SALES SERVICES REGULATION?

According to Article 2 of the Regulation, it is possible to give the certificate of receipt of the goods and the service receipt to the consumer with a permanent data storage. Upon the consumer’s request, the receipt of the goods and the service receipt must be given in writing on paper. Confirmation that these documents have been given to the consumer can be obtained in writing or through a permanent data storage. The burden of proof that the consumer’s approval has been obtained rests with the service station.
According to Article 2 of the Regulation, in case the receipt of the goods is given with the Permanent Data Storage, the signatures of the deliverer and the recipient will not be sought. In case the service receipt is issued with the Permanent Data Storage, the signature of the service station officer and the consumer will not be required.
